And where does ethics, and the rights of opressed minorities fit in?

That is, Scalie seems to support Jim Crow, obsolete laws banning various
practices in the bedroom, and who knows what else. Where is the law "as
practiced by society?", unintended consequences, and then-unknown
technology (the net!) etc.

He should read the legislative history behind anti-abortion laws, which has more
to do with the AMA wanting a monopoly over midwives than it does over any moral
outrage at the process.

Similar for the laws banning Marijuana. The AMA didn't even support that....it
was so the government could arrest any uppity mexicans who threatened the farm
labor system with things like a right to be paid for work done.
