As I suggested above, it's almost certain that their code started from ext2.
It's a pattern with companies that claim to have developed a "proprietary
super-advanced" Linux filesystem.

I don't know this as a certainty, but it's a logical conclusion. They didn't
bother to do a clean room implementation of the easily documented utility code,
so it's very unlikely they started from scratch with the complicated in-kernel
code.

Twin Peaks was expecting that this case would remain limited to a patent battle.
They either didn't think about their code base, or believed that it could be
kept out of discovery. Now that their source code is a legitimate subject for
discovery, they are trapped in a losing case.
