GPLv2 allows the licensee to choose to use the code under the GPLv3 license,
unless the code is actually originally licensed under a modified GPLv2 (e.g.,
the Linux Kernel license) that removes this option.

This means that Twin Peaks can avoid termination by releasing all GPL source
under GPLv3 some time in the next 30 days.

I don't think that this relieves them from penalties on past violations, but it
would allow them to stay in business.

The parties can agree to whatever they want and keep the terms confidential as
often happens. They would not even have to address the GPL, publicly at least.
Some other party would have to jump in and use it.

The parties will probably try and come up with a public statement that serves
their interest. RH would like some lip service indicating the strength of the
GPL and copyright sanctity.
