I think that Judge Koh should look in the mirror and ask herself how could htis
trial go so wrong. This trial was very complex and tere was a lot at stake for
both parties. The more it was compressed , the greater the probability of
causing an incorrect decision.
Quinn made a statement early on to the extent " what is the purpose of
having this trial" - my memory, probably not the exact words. He is an
experienced trial lawyer and he could see this trial going off the rails early
on.
Unfortunately, if everything I read in Groklaw is an indication of what may
evolve, the follow on activities are going to take a lot of time and
considerable expense for the parties as well as the judicial system. Sometimes
is does not pay to rush thru a complex issue as it will come back to create more
work / expense, not to ignore that the reputation of the judge may end up being
tarnished.
