In the absence of a Samsung motion...

I would expect Apple to leave the decision to Koh to decide that issue. They
already have what they want and Koh is unlikely to change that for a number of
reasons.

The thing about lawyers is they plan for
all contingencies. That's their job, to
make sure nothing surprises the client
and that they are prepared no matter which
way it goes.
