...that shortly after the jury ruling I expected Apple to
at least get a
nearly immediate temporary injunction
against Samsung's offending
products, to be made permanent
or not after the appeals. Apple of course would
be screaming
for this, and saying every day they wait is damaging to
their
sales. I would have expected an injunction to be
slapped onto Samsung's
offending products at the same time
the injunction is lifted from the single
non-offending
product.
Then I was so surprised that the judge was
happy to lift the
injunction on the non-offending product quickly, but was in
no hurry to act on the jury verdict otherwise, in spite of
Apple's

Imagine you were the judge, knowing your capability, but
also well aware of
your inexperience, also aware of your
peers watching you. The jury decision is
in, and you have
had a few days to reflect upon it all now - all the
confusion
during the trial, and the mistakes you made, the
stunningly swift and dramatic
jury decision, followed by all
the reports about the jury foreman in the
press...
Then you think, there is at least one mistake you can
quickly
undue - the injunction against the non-offending
Sampsung product, but the rest
of it all... Wow, what a
mess! It is going to take some time to clean it all
up.
Better give the parties plenty of time to articulate it all
from their
points of view to help you figure out what to do.
