You don't know anything to base a guess on.
Nobody does. This is new territory, so
guesses have no value, being based, as they
must be, on thin air.

And, yup, we are in uncharted waters, so *everyone* is guessing speculatively.

Me:
I hope Judge Koh calls Judge Alsup for advice. Her whole trial process says she
needs it.

My (equally uninformed speculation)
Samsung will ask for mistrial at the next hearing; Apple will violently
disagree...Judge Koh will realize she needs to think, lift the preliminary
injunction, and not rule until possibly December. Flip a coin as to what
happens then -- it has to wait for appeal or she grants the mistrial, and the
result depends on whether and what help she gets from older, wiser judges.
Granting the mistrial would be bold, but correct and *very* inconvenient. She
will get no love for either decision, and my money says there will have to be a
re-trial, absent the patent office tossing the patents, which might happen if it
has to be decided on appeal.

As a time manager on this case, I would do what Alsup did: Divide into
phases...starting with the validity of the patents, before I allowed anything
else in my courtroom.
