ISTR old magazine cartoons of characters waiting at the Patents Office clutching
wierd contraptions. Under your
definition of an invention neither this guy nor this one would get patents,
while these
two would. Perhaps
the modern trend to vaguely worded
all-encompassing applications for abstract concepts is a reaction by both
inventors
and the USPTO to these
conditions .

The guys would put a programmed computer in the tub and claim your test is
passed.
This is the loophole they use. They say they don't claim the idea, they claim
the programmed computer.
It is a bit like arguing they don't patent a novel, they patent marks of ink on
