Patent from "Letters Patent"

As in the same process as issuing honors and arms - a letter
bearing the Great Seal of the Monarch of the UK. Earliest
known patent from the UK is from 1449 (and predates the UK).
Note this does not deny other countries may have had similar
systems, but this is where the UK and US name "patent" comes
from.

So patenting maens an exclusive use granted by the Government...the
PTO is concerned with Utility patents and design patents.

And given the avoidance of the exact term in the constitution, there was
probably a lot of negative freight associated with the word patent in the late
1700s.
