If you go online to the AppStore, or in special circumstance where
you can't download, go to a retail Apple Store, and ask to purchase
MacOS X, you will be sold Version 10.8.1 also known as Mountain Lion.
Previous versions are obsolete, altho' still supported by security updates.
Version 10.8 containing the alleged infringing features common to iOS
was not available before 25 July 2012.
