In this particular instance, Samsung already had a license
from Neonode for when they developed the SGH-Z610. Probably
that patent license still exists to this day.
Engadget back in Oct. 2006 had an article on the progression
of the FCC approval for sale in the US.

May need to be done at the patent office. Depending on how the case is retried,
