According to iTunes own words "Apple is the provider of the iTunes Service,
which permits you to purchase or rent digital content ("iTunes
Products") for end user use only under the terms and conditions set forth
in this Agreement. ".
So, if he "purchased" music from the iTunes store, he's got a sure
winning case. If he "rented" it, then he's sure to lose.
The doctrine of first sale is well documented for music and video. It's software
that has the issues or contractually limiting it's possession status.
Words are important, and the courts give them specific meanings. I knew, there
