Now, let's have an emergency....an exhausted hiker, maybe a bear attack
or snakebite, or a trail mainainer gets stuck under a log, or a forest fire that
is almost certain to leave the wilderness and destroy homes upslope or
down-wind.
Scalia wants to deny the rescuers the commonsense use of chainsaws and
motorized vehicles that may be needed in the evacuation as a matter of law
because the situation wasn't specifically thought of by the legislators?
Especially with new and unfamiliar technology? That's just the same
removal of the totality of circumstances and intent in "zero
