The patent reforms seem to go a long way towards dealing with this. It goes into
effect on the 16th of September I think, and defendants have the option to
choose jury or the panel of patent judges. These judges not only are supposed to
have expert knowledge of patent law, but also of engineering/computer
science/whatever is at question. I assume it'll be a mix group meant to inform
one another.
They also will not have to operate under the presumption of a patents validity
simply because it was issued, in recognition that the process begets broadness,
nor will they have to base their obviousness arguments as meticulously on
matters of fact like courts currently do.
