I want to clarify that I am not trying to say that
everything said by the
Foreman is false and cooked-up.
To put it simply,
- There
was a highly one-sided coverage in the media
about this case as rightly noted
by Groklaw
- There was a trial and a verdict
- Verdict saw an
entirely opposite reaction, where most
of the tech-world, legal-world and the
media were surprised
at how quickly the verdict was arrived at
- Jury
Misconduct and other things have been discussed at
length after the
verdict.
- The foreman felt he needs to justify his stance and the
jury to
prove that they did a good job. He did not owe an
explanation to anyone. He
could have simply said "no-
comments" and remained silent.
- And some facts
presented by the foreman sound too far-
fetched to be true. Mainly because they
just did not spend
enough time to really do all the stuff they claim to have
done
E.g.:
- Get hung up on one issue for one whole day
- Then go
on to discuss each patent, clause-by-clause for
invalidity and
infringement
- Analyze source code to understand Apple's, Samsung's
and
prior art's implementations
- Dig into full-specification of 3GPP instead of
looking
only at the evidence shortlisted by expert-witnesses
