not some idealistic thing about
protecting the
innocent
I would say the fact that "protecting the innocent" goes
hand in hand with "if you're going to be punished anyway, might as well do the
crime".
Of course there are those of us who won't commit the crime even
knowing we're being punished for it.
Personally, I prefer to think of it
along the lines:
Which is the lesser evil?
The choices being (worst
case):
Letting a serial killer go free because of insufficient
evidence
vs
Sending an innocent man to Capital Punishment
In both
cases:
The murderer is still on the street
However:
By sending an
innocent to the chair, you are guilty of murder yourself by killing the wrong
person!
So... sentencing the innocent is - by far - the greater
evil.
