Gamer Dude held out an entire day. It was
on the second day, after the foreman "explained"
prior art with his aha moment that he caved.
And that is his fault.
For the record, I would always, always want
a jury over a panel of experts. Look at the Federal
Circuit. That was the whole idea, to have expert
judges in patent law. But the end result is that
they tend to fall in love with patents if they were not
already ex-patent lawyers.[ Reply to This | Parent | # ]

This is the eternal problem for cases like this. If you use experts to decide
the case, then they will understand what is involved, but will almost certainly
have their own prejudices. If you use laymen, then they won't have prejudices
about the issues, but they also probably won't completely understand the
issues.
Really to decide a case like this without the benefit of technical expertise is
rather like playing Pin the Tail on the Donkey. It's just that by the time
someone is technically competent, they also have formed opinions about this type
of issue.[ Reply to This | Parent | # ]
