From what my understanding of what I'm reading, yes potentially if they raise
questions regarding it before they actually begin the appeal

Doesn't this story remind us of "The Runaway Jury" by John Grisham in
which the anti-tobacco lobby gets a plant into a jury to rule for the first
successful suit in a tobacco related death. I can see this foreman getting in by
luck but just as easily by manipulation. He certainly appears to share some of
the same attributes as Nicholas Easter, the plant in the book.
