The district judge could throw out the verdict on those
grounds alone, if she saw fit to do so. Given the location
and her previous antipathy to Samsung, I see this as
terribly unlikely. It's hard to accept any suggestion that
the jury give this case proper attention.
Of course, the appeals court is the next step up, and
Samsung can fight all sorts of things: the magistrate's
arbitrary treatment, the judge's creative interpretations,
as well as the decision of the jury and how it was made.
One can only hope that Judge Koh is thinking long and hard
about what to do. Does she really want to be remembered as
the judge who fouled up the biggest case in US patent
history?

The jury is sacrosanct in American jurisprudence. It's rare that a judge will
overturn a jury's verdict, not unheard of, but very very very rare.[ Reply to This | Parent | # ]
