besides your opinion, what makes the damages punitive? seems to me they
split the difference between the damages suggested by Apple's and Samsung's
experts.

Judge Koh gave both parties a chance to dodge sending the issue to the jury. Indeed, uncertainty as to how a jury will respond to the evidence is a good reason to settle before going into court.

I know you have your disappointments with Judge Koh, but I like her. I think when Samsung makes their 50b motions regarding prior art, if the prior art evidence presented was solid and on point regarding the law, then the patents will be invalidated, the awards disappear, and the active products go back on market.
