Interesting legal precedent he seems to be trying to set.

His thoughts on patent infringement are also groundbreaking
however, so I think we should wait for more wisdom before
drawing any conclusions.

Frankly the trial was so flawed anyway that a little bit of
creative behaviour by the jury is not the greatest of the
problems with the verdict.

Not only different CPU but code for windows will not run on linux and vice
versa, so that should apply as well. So a patent that microsoft has shouldn't be
applied to Linux as infringing. If they followed this blokes reasoning there
would not be many patent court cases would there.
