They bought legal software, installed it on machines in
violation
of the EULA, and sold those machines with the
software on
them.
Actually, they bought legal software and instead of
installing it on machines the sold, which would just be a
violation of the
EULA, they installed modified copies of
another instance of the software, which
is a copyright
violation.
Now, if your definition of "first sale" covers
that it
isn't the same definition that the law has.

whether the number of copies bought equals the number of copies sold.
There were certainly rumours floating around that the number of copies bought of
OS/X fell well short of the number of Psystar computers sold.
Plus, all copies of OS/X available retail were *upgrade* copies. Installing on
new hardware is not an upgrade.
