Jury malfeasance the result of the judge.

I don't know if I would call the simple fact of keeping the
jury awake a bad thing on the part of the judge. But the
actions of the jury do reflect on the judge. So yeah, the
members of the jury can't be excused from ignoring
instructions... but the judge is the one who made the
instructions so tough to understand and with such a lopsided
trial that one can understand why the jury leaned the way
they did.
