Even judges seem to think that "ideas" can be patented. It is not
supposed to work that way, and the law prohibits the patenting of ideas. A
particular device that reads gestures by a specific mechanism might be
patentable. The concept of reading gestures should not be patentable.
Unfortunately, modern patent law, as promulgated by the CAFC seems to think that
all you have to do is say "A device that implemtents CONCEPT A" and
you magically have a patent that covers not just your implementation, but any
possible implementation of CONCEPT A. CAFC has changed the law to allow the
patenting of ideas via a linguistic trick. It is, of course, all contrary to
law, but if the police force and the lawyers and the judges all agree to violate
the law, what can you do?[ Reply to This | Parent | # ]
