I blame the judge for letting so much into the case, that it not only overwork
the jury, but also end up muddling and confusing the facts till there's probably
no fair way to figuring out what's true and what's false.[ Reply to This | Parent | # ]

This judge did such a miserable job. For her, process
outweighed getting to the truth.
In these technically challenging cases, the judge's primary
task (beside ruling on matters of law) is to ensure enough
context is provided so a jury can make sense of issues well
above their heads. They must ensure that the opposing
lawyers do not take advantage of the system by using legal
maneuvers to obfuscate the facts of the case. It is hard
enough for the jury even without that.
