The Jury is not required to review all the evidence
Authored by: Anonymous on Tuesday, August 21 2012 @ 07:42 PM EDT
All the evidence is available to the Jury, but nothing says that they have to go
back over everything again.

They could meet, select a foreman and then take a vote and find that everyone
has the same opinion and return a verdict in 15 minutes.

This is extremely unlikely, but possible.

The more common thing is to vote and find what everyone is thinking and then
talk to find out where the disagreements are and then go over evidence (and look
at notes, request readings of testimony, ask the Judge questions, etc) to as
everyone is trying to convince the other jurors to agree with them.

How much evidence they end up going back over depends on where they disagree,
how much they trust their notes and memory of what was presented, etc.

Brand Recognition? Samsung is Stronger
Authored by: Anonymous on Wednesday, August 22 2012 @ 03:24 AM EDT
More people have or have owned a Samsung Product than an
Apple product in this country. Samsung is literally a
Household Name in consumer electronics outside of wealthy
elitists. Apple while only in RICH Circles of Computer
owners are still but newbies in phones. Samsung TV's are
Ubiquitous as are their phones (#1 phone maker by volume
here, not just smartphones). AppleTV is more commonly
associated with Failure like... Newton. If these jurists are
typical Americans, they realize we no longer live in a
country where Apple is considered any more American than
Sony, Toshiba, Toyota, BMW and especially Samsung. Who all
produce parts/products right here in America. Not just
designed here and made in China!

Samsung was the #1 Investor in America (CiCi Award), now
2yrs running and are investing a Record $4 Billion Dollars
this year and again next year. Bound to break a record as
CiCi Award Winner 4yrs in a row (Apple has not even been on
that list). Samung gives more high paying jobs (engineers,
etc) directly to Americans, than even Apple here. Unless you
put stock boys and Geniuses in that category. Samsung sells
Washers, Dryers, Auto parts, mining in PA, Construction
Jobs, hard drives, computers, Silicon chip design right here
in Silicon Valley (just signed expansion deal w/Gov). Along
with their smartphones/tablets only being a small part of
that. Without qualification (just smartphone) more people in
America own a Samsung phone than do an Apple phone by a huge
margin!

We're not talking expensive niche products. We're talking
products any citizen can own. Not just those that repeatedly
buy Apple's products out of Planned Obsolescence, tossed in
a drawer yr after yr, obsessed by loyalty, or endless over
hyped media appeal. We are talking about, they use them
everyday!

This jury is a slice of that American Pie. That may not have
a need, want or the money to merely keep up with the Jones!

That why I say Apple was wrong to go for broke with an all
or nothing appeal to the average American (potential
jurist). Who may still not even know a Patent War exists.
Let alone own an iPhone or iPad or any other Apple product
except maybe an iPod. The heavily skewed numbers pointing up
Apple as the largest selling brand, only point to revenue
and profits spent by a minute portion of the American
Public. Get the facts and in America Samsung sales are far
more Ubiquitous with greater volume sold to those actually
owning a SAMSUNG Product. Who don't give a dam how much
their Market Cap this week or what it will be next week is.

So if as an average consumer picked to a jury, all this
chest pounding and braggadocious self inflating "Jony Ive"
invented everything, including the letter "i", isn't worth a
hill of beans to them in court. In one average neighborhood,
we only need look around us to see that the Arrogant
Wizardry of Apple is all just so much..... HUMBUG in the
Real World!

btw... if you think Apple is a big investor in America you
are sadly mistaken. You only need to see their Total NET
ASSET value to understand that. They lease most of their
space (like from Samsung in Austin TX) and the New Donut
Campus? Only $700 to $900 Million tops over 4yrs, won't put
them on the CiCi Award list in any of those years!
