for copying the overall “look and feel” of plaintiff’s retail jewelry websites,
including the design of plaintiff’s search pages."

but also
"It is unclear, however, whether a trade dress plaintiff must cling to the
precise language of a trade dress as stated in a complaint, or whether a
plaintiff may offer a revised formulation in another filing. There is at least
some support for the proposition that a plaintiff may offer an updated
formulation at a later stage in the litigation."
So, if the plaintiff may update his/her complaint, the defendant should be able
to update too, I guess.
Still, as we have a jury rather soon that may be all too late. It would have to
come from an appeal, if they lose.
