Nor should they be able to produce a near-exact replica of a VW, down to exact
colors, exact corner
radii, exact trim materials positions and arrangements, exact grill
ornamentation--and then stick
their logo on it.

And yet, somehow, I can easily tell most of them apart from 50 yards away. Could
it be that their
manufacturers strive for distinctiveness instead of trying to clone? No, surely
not! At least not in the
bizarro alternative universe that Groklaw has become in the last couple of
weeks. In this world all
hatchbacks look so much alike that clearly there can be nothing protectable
about their appearances-
-because it is necessary that it be so in order to make the analogy to tablets
which must also all look
alike and may have no distinctiveness in their designs.
Hogwash.
And for all the people comparing me to SCO trolls: hey, I put my money where my
mouth was back
then and I made good money on SCO stock; shorted it the day after their idiotic
Linux conference
