Perhaps the most frightening thing about this is that this is a man who sits on
the committe that governs the science funding done by the US govt.

He may have meant that if the intercourse was without the woman's consent,
before and/or during but prior to completion, that it would be legitimate to
declare it a rape i.e. legally, according to the law, whereas if both parties
consented to the intercourse at the time during which it occurred, and then
later one party, for any reason, declared it was a rape, it might not be truly,
or legitimately, a rape, it might be an attempt at revenge or regret or other
reasons.
However the choice and sequence of words when viewed literally is most
unfortunate for him.
