Then there's Google Caves To Hollywood Pressure: Will Now Punish Sites That Get Lots Of 'Valid' DMCA Notices.

Relying on take down notices seems so much like group sourced censorship. We saw how a large number of 'legitimate' providers of content on MegaUpload were cut off from their content by the government's collusion with the MPAA et. al. Then there's NASA having access to their own video cut off by take down notice on YouTube.

Giving an inch isn't a win for Google. It's driving culture elsewhere, which when you contemplate walled garden sharing or social efforts might be a good thing.

Starting next week, we will begin taking into account a new signal in our rankings: the number of valid copyright removal notices we receive for any given site. [emphasis added]

Now let's not think about whether a takedown request sent to Google in respect of a third party site can be valid. Google is pretty sure they don't have any right or duty to "takedown", they're merely downgrading the rankings. But Google's gonna have to dig a lotta dirt to find out if if the third party is infringing before they downgrade it. Here's how much dirt .
