On cell phones, the date and time are very rarely not correct
as they are critical to the operation of the phone and are
provided by the various cell towers that the phone is in
contact with.

Samsung lawyer admited mis-speaking

The above subthread points out ways the phone might have the date incorrect, but
it's all moot since (according to the article) the Samsung lawyer admitted that
he mis-spoke about the date the picture was taken.

I open and activate phones at work all the time (75+ phones)
every phone out of the box and powered up has the current
time/date on it. A few times (on older android phones) it
showed the time as GMT and not EST where I am located. When
shipped from the carrier they are already talking to your
closest cell tower and getting NTP from there. Even without
service activated a cell phone can call 911
