And which version of android out of which box ?

Firmware updates change what icons are available, where they
are placed and what they looked like.

There is no single way in which one phone comes out of the
box depending on where you bought it, when, when it was
flashed and who is the carrier. Then apply that across 4
different phones (Epic, Fascinate, Captivate and Vibrant
IIRC) each that was on a different network with different
degrees of customization...

If the judge doesn't understand that Android is a LOT
different to iOS in terms of it being customized by the
carriers then this trial is going to become a farce and real
soon.

Its already getting silly. Samsung only are responsible for
the hardware and TouchWiz. If she thinks android as a whole
looks too much like iOS or that specific carriers versions
do, that isn't Samsung's fault, but she'll still find
against them.

Seems to me they should have brought a new phone, still in box, sealed from a
carrier say sprint, and powered it up right there and then in front of her.

it is the rom that matters. Whether that rom is designed by
the carrier or manufacturer it's usually a combination.

There's no reason a homescreen cannot have a google search or
must have a google search on it - it can always be added by
the user if thy want.

Can't remember exactly what my Galaxy had on its screen when it came out of the
box as I've so customised it now - *ALL* the icons on the home screen are user
selectable; I didn't quite wipe it clear to start with a blank canvas to put in
my favourites and get it similar to my previous phone, but it's how I want it
and to be blunt, I've never seen an iPhone's home screen so if it is similar, it
is clear that the arrangement is obvious and not patentable.

Yeah, my Galaxy Ace had a whole load of iPay apps on the home screen, designed
to wring the most out of a data plan. Must set about rooting it and get rid of
them as they will never be used and are just hogging space. (Deleted from HS but
still on phone currently)
