Well, Apple's position, as Schiller said on the
witness stand (one of the links in the article)
that if you lose a sale, it's not just one sale.
People tend to stick with an ecosystem once
they buy a product, if they like it. It's hard
to get them to change later. So it's not just
that one sale of a phone; it's the next phone, and
the tablet, and the next, and the apps, and all of
that.

Pity for the poor people who went into the apple store or the
apple section of Best Buy and bought a Galaxy tab.

The confusion is immaterial.

Makes me wonder if people really do believe that all phones with rounded corners
of a particular colour is an "eye phone", then maybe the trademark is
already diluted?
