See, some creativity is needed even to walk from point A to point B. By your
logic everything one does is a creative work (which to some degree it is but
there must be some line).
The facts are that this stupid little function was immediately rewritten by
Google and this rewrite was absolutely no problem for Android.
So answer these questions:
1. if google knew the code is copied would it not immediately replace even
before the trial?
2. did google benefit anything remotely measurable for this short simple
function?
3. On what grounds could Oracle seek any damages for something replaced
immediately after google was made aware it is copied?
4. what is significant? is not significant something that makes a difference? To
whom does the rewritten rangeCheck() function make any difference? In other
words who would notice there is any difference before and after the rewrite of
