Food Fight in Apple v. Samsung ~pj
Authored by: Anonymous on Thursday, August 02 2012 @ 09:57 AM EDT
Finally, returning to Mr. Lee's complaint about Mr. Quinn's response, it seems
to me that he is applying the age old principle whose originator I have so far
failed to trace:

"If you have the law on your side, pound on the law. If you have the
facts on your side, pound on the facts. If you don't have the facts or the law,
then pound on the table."

I'll continue that statement a bit:
"...If you don't have the facts or the law, then pound on the table. If
you don't have the table either, pound in the press."

This was a calculated move by Samsung in an attempt to introduce the jury to
this evidence which a) doesn't stand up to analysis, and b) was introduced too
late to be allowed into the trial in the first place.

Apple's statements that they think Samsung 'slavishly copied' the iPhone's
design isn't anything the jury won't be exposed to during the trial. In fact,
it's the central claim of the Apple's case. If you can't distinguish between
making *those* statements to the press, and waiting until after the trial has
started to make a media push to get 'evidence' out there that you didn't submit
properly during discovery, in order to try getting it in front of the jury, then
I don't know what to tell you.

(Oh, and the Samsung had, and took, the opportunity to appeal the exclusion of
this evidence. They lost. More than once.)

I ask this with all due respect, but is there a place that I can go to read
about this
case that isn't obviously in one corner or the other? There's too much Apple
hate
on Grok, and too much Apple love everywhere else. I'd just like to know the
actual facts without the legions of nerds emoting all over the place.

Did Samsung copy Apple? Don't know. Here Apple is the devil, so they not only

stole it all from Samsung, but they kidnapped Samsung's children and used them
as spare organs for Steve. Rah Rah Android...
