This struck me as an important point: We are really watching
a fight over the future of Silicon Valley. If Apple wins,
there will be serious repercussions for US based startups. If
Samsung wins - well we live to fight another day.

Correct. Why are smartphones rectangular? Because the LCD
panel is rectangular. Why is corners rounded? To prevent
people from getting injured by sharp edges. Why the
limited number of physical buttons, and use of soft buttons?
Because they can be reprogrammed and moved via software -
which is easier and cheaper to upgrade.

Most of the Apple "Design Patent" is simply a smart, but
well-known (none of the above was invented by Apple)
principles, and others (like rectangular shape) are forced
on them by Hardware limitations. This Design Patent should
never have been issued.
