The Problem
Authored by: Anonymous on Wednesday, August 01 2012 @ 01:39 AM EDT
The problem is this jury includes a person who doesn't even own
-any- kind of cell phone. How are they gonna tell the difference?

The problem is if you demonstrate the two side by side on a table
covered in a long black cloth, with the jury in the bleachers, they
are liable to think it's all smoke and mirrors and award damages
of $1.00 to each party.

I'm not putting any money on the big evidential disclosure:
ten in the jury = five Apple products + five Samsung products
for them to maul and crawl during deliberation.

Wasn't there some discovery relating to the relatively large number of samsung
products returned to bestbuy since they weren't ipads/iphones?

That speaks tellingly to consumer confusion between the apple and samsung
products. And to the effect sales commissions have on salesman behaviour.
