Actually, they can. Trade secrets and confidentiality agreements are very much
allowed.
Just because a company is publicly traded (note: neither Samsung or Apple are
public companies, as they are not government owned/operated) doesn't mean they
cannot have their secrets.

Oh, yes they can.
Even worse, Governments - you know, the bodies we elect and
can take our cash and other possessions by force of law -
can and do make secret agreements too. In a whole raft of
areas. One is international diplomacy. Even worse are
agreements with commercial companies wherein the use of the
aforementioned cash cannot be laid open to public scrutiny
as the contracts are "commercial-in-confidence". The way
actions of Government can be hidden via this method is one
