What an interesting scenario this seems to present:
Roger and Knight-Ridder own the copyright to the rectangle with rounded corners;
and yet
Apple appear to own the design patent on it (of a later date).
Is it legal to design patent someone else's (previously) copyrighted design?
Or have Apple licensed it?
R & K-R wanted it free for anyone to implement, but Apple appear to claim
they own it and only those who have a licence from them can implement it!
Methinks something's a foot (other than 12 inches) - it just doesn't add up. [ Reply to This | Parent | # ]

From what I can make out, these design patents are meant to cover the same
ground as trademarks. Namely prevent others from trading on your good name.
Note the references to the law saying "if a knowledgeable observer would
not be fooled, then no copying has occurred".
In other words, the purpose of this is to prevent the public being fooled.
Seeing as Samsung make no attempt to closely imitate Apple, this *should* end up
being thrown out as a malicious lawsuit. What's the chance of this happening?
I know - the US system has absolutely nothing to do with justice, and everything
to do with big pockets :-(
