Has IBM given up in the SCO case?

It was SCO that put it on ice when it filed for
bankruptcy. The only way to go forward was for
the bankruptcy court to say OK. IBM did not
oppose that happnening.

Then the delay was because judges kept recusing
themselves, one after another. SCO in June filed
a motion to go forward, and we are waiting for
a hearing date to be announced.

My point is this: your assumption that it's IBM
that is causing a delay is laughably incorrect.

I checked PACER and nothing new there, which means that
IBM does not seem to care about opposing this motion.
