The fine might not kill them, but there more and more stale products will.

fines are independent of hurt/kill

Some fines can easily kill a company quickly. You do not want to be caught
violating TSCA (the Toxic Substance Control Act) in the US. The automatic fines
will easily destroy most companies if the time between occurrence of the
violation and being caught is at all significant.

The purpose of a fine is not to kill, but to punish and deter. At the same
time, the purpose of a fine is not to not kill. MS has grossly distorted the
markets, which is why the original agreement took place. Now, they have failed
to meet the end of the bargain they were responsible to meet.
