Is there an official record of the 11-1 split in the court record, or is it only
anecdotal reports from the jurors after the event?
I have seen this 11-1 figure quoted authoritatively many times, but don't
know how much weight can actually be given to it.[ Reply to This | Parent | # ]

No, that's not what he means. Keep in mind that you have to use the legal
definitions of the words and phrases.
It's not unusual for a judge to overrule a jury like that. IANAL, but I can't
think of any way for them to do it where they *don't* say that a reasonable jury
wouldn't do what the jury just did. That happened in the Oracle / Google case,
as a matter of fact. (There were fewer than 12 jurors, but still, the judge
overruled something that was unanimous.)[ Reply to This | Parent | # ]

"Are judges basically allowed to say that the US jury system is defective
to the point of being dysfunctional?"
If he (Motz) were to say that, maybe he was looking in a mirror at the time?[ Reply to This | Parent | # ]
