The pop-unders are still obtrusive and distracting when they reappear from under the window I was actually using. Fortunately not many sites use them any more.

Another problem with pop-unders is that they can consume resources (decoding and animating a large image) and might even play sounds to attract attention (although they are usually more confusing than attention grabbing).

Online advertising is a sadist's game.

I think that it is clear that the intention is something like a status indicator
that sits in a corner of the screen that is not flashing or obtrusive, but
contains a static (not blinking) status icon or a line or two of text with the
news or status information that is being updated in the background when there is
some new information or news.

Whether the requirement that it be unobtrusive and on-distracting is too
indefinite and subjective to be a valid patent claim is another issue.

MS has the patent on pop-unders

Windows installer has for many years displayed the ability to
display images in an unobtrusive manner that does not
distract the user. It even uses the method on dialog boxes
requiring user input.
