While yeah, Novell were idiots if they didn't expect MS to go after them...
isn't it irrelevant here? "We were well known for our abusive business
tactics so you should have known" doesn't sound like a particularly solid

That's a point of view that doesn't match how
law works. Somebody has to win if somebody
loses. You can have a Posner decision where
neither side wins, but if someone loses, there

With all Microsoft's history and background, with Elop coming from the upper
echolon of Microsoft.... Nope, the stockholders shouldn't have any kind of case
against Elop for mismanagement in selecting Microsoft as their only
platform.
Just to be clear: the above is how I understand you're
saying:

Sorry... I disagree. It's got nothing to do with
"deserving to win". This isn't a friendly game of baseball.
This is a
situation where entity A unlawfully harmed entity B.
As a result:
A:
Entity A should be punished
B: Entity B should be compensated in some
way to ease that harm that was caused even if Entity B can never be made
whole.
Taken in the context of a serial killer, would you honestly
say:
Look, everyone can read the papers. Every Paper for the last two
months is saying the serial killer is targeting every blond male over the height
of 6"5'. On a daily basis. It's that dumb blonde's fault for going out for a
walk alone. His family doesn't deserve closure with regards the serial killer
being caught and sentenced.
Do you really, honestly, believe that?
I
certainly hope you don't. I hope that there's a more reasonable explanation
like - perhaps - negative emotions you have directed at Novel are speaking for
you.
It's a real pity when someone actually believes the victim deserved
to be a victim.
Could Novel have done something else? Absolutely.
Should they have? Wiser minds that know Microsoft think so. But does that
detract the fact that Micrsofot is responsible for the harm caused to Novell?
Absolutely not.
