Judge Motz has been strangely forgetful. Why? I know I'm much more likely to
remember things if they make sense and I have respect for them. I don't remember
nonsensical things well. Perhaps the nonsensical nature of this case is at the
root of Judge Motz's forgetfulness.
It just doesn't make sense that Novell could have been as gullible as they are
saying they were. Novell's case depends on Novell being too clueless to have a
contingency plan in place for Microsoft not coming through with the namespace
APIs. PJ's article reminded me of how stupid that would have been. Judge Motz is
supposed to believe that they didn't know any better? After the way Microsoft
lied to them in the past? Really?
My guess is that he has contempt for both sides, is trying to hide it, and just
wishes the silly case was over. One thing that makes the case absurd is that
Microsoft won't even try to defend themselves by pointing out how ridiculous it
would have been for Novell to trust Microsoft because that would be such bad PR.[ Reply to This | Parent | # ]
