Unfortunately, that's penalizing the punter for the Appeal Court's stupidity.
I totally agree the losing side should pay the full costs (including attorneys),
but that's a matter for legal reform. It's NOT right that that should be done
because the appeal court behaved like a bunch of idiots.
There's justice, and there's justice ...

Actually, that is SCOTUS's main avenue for dealing with a "runaway appeals
court". It is perfectly legal for SCOTUS to issue a reversal without
comment.
They don't do it that often, but it means they don't really have to spend much
time on the rogue court; they can just say "Oh, they approved another
software patent? Reverse." Eventually the flood of daily reversals will
cow the CAFC crooks.
I don't think the current SCOTUS has realized how bad the situation has gotten,
so they're not ready to do that particular type of smackdown yet.[ Reply to This | Parent | # ]
