OK - can SCOTUS reverse and award full costs against the losing party?
Full costs would surely squeeze the punters and the message will get through

I don't know, it sounds to me like this is significantly different from what he
predicted. He seems to predict that the CAFC will chip away at the new
standards, bit by bit, in small ways that move in the desired direction without
motivating SCOTUS to weigh in.
This sounds more like balking at the new standards almost entirely in the course
of one case, which is theoretically more risky precisely because it makes SCOTUS
