In functional democracies, this sort of behavior by appeals courts
results in judges being removed from their positions.
Legal error
decidedly does not result in an appeals court judge being removed in a
functional democracy. The idea is that a higher court can and should correct
legal error and that ought to be the case here.
Perhaps you believe that
court judges should be controlled by the legislative or executive branches, but

All congress would need to do is remove exclusive patent appeals from the
Federal Circuit.
Let the regular Districts rule on them and then the the Supreme Court resolve
any discrepancies, just like most other types of cases. Patents are too
important to be filtered through the single viewpoint of one Circuit.
