If this is the case, where he wrote the software used as prior
art and then filed for the patent, he is guilty of fraud for
misrepresenting the patent as novelty when he is the one
knowing the killer prior art.

Would be so nice to get one arrested for doing this, even if
i'm sorry for this guy. The example made would really hurt
Apple case and discourage this madness happening on patents.
