See The Evidence? Ha-Ha, you must be kidding
Authored by: complex_number on Friday, July 06 2012 @ 03:21 PM EDT
NZ id no different from the UK in that the FBI etc don't have to show anyone the
evidence against you until you are inside a US Chokey in chains and leg irons.
All that have to do to get you extradited is show probable cause.

With the possible jail terms of 200+ years for a non capital crime being banded
about it is little wonder that there are a good number of people who think that
the US legal system is failing badly.

I wouldn't want to be the prosecutor putting forward a theory like that.

This is the story of what happened when a US prosecutor used emergency extradition powers to arrest someone, while he was giving testimony in court, in Canada:

New Zealand Police Investigated over MegaUpload’s Founder Arrest
Authored by: Anonymous on Saturday, July 07 2012 @ 07:13 AM EDT
The country is currently conducting a judicial review as to how its police ended up carrying out a bizarre unauthorized raid on Kim Dotcom, the cyberlocker’s owner. The officers who carried out the police raids on Dotcom’s house will have to take the stand in order to give evidence for the judicial review.

I would love to see the judge declare the US and its legal representation in NZ
to be in contempt of court and ineligible to present any case until all of those
disk drives and clones thereof have been returned to Mr. Dotcom.

He'll have plenty of time to see the evidence, when he enters the court system.
The prosecution has to provide all evidence, even exculpatory evidence, to the
defense. They're not holding his trial in NZ; his trial will be held in the US,
if they ever get him extradited.
